Please read these Terms of Use (“Terms”) carefully before downloading, installing, or using the Pham Theu mobile application (“App”) on your iOS device.

By accessing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App and uninstall it from your device.

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple devices you own or control, subject to the Apple Media Services Terms and App Store rules.

You may not:

• Copy, modify, translate, reverse-engineer, decompile, or create derivative works from the App.
• Distribute, rent, resell, sublicense, or commercially exploit the App beyond permitted use.
• Remove or obscure copyright, trademark, or proprietary notices.
• Use the App for unlawful purposes or in violation of third-party rights.

3. User Accounts

Some features may require creating an account or signing in (e.g., Sign in with Apple). You are responsible for safeguarding your login credentials and all activity under your account.

You agree to provide accurate information and notify us promptly if you discover unauthorized access.

4. Content and Services

4.1. Content Provided by Us

Embroidery patterns, guides, images, and other materials in the App are owned by us or licensed to us. You may use them for personal, non-commercial purposes unless otherwise agreed in writing.

4.2. User-Generated Content

You retain ownership of content you create in the App (notes, photos, projects). By uploading or saving content, you grant us a non-exclusive, worldwide, royalty-free license to store, process, and display that content to operate and improve the service.

You represent that your content does not infringe intellectual property, privacy, or other rights of any third party.

5. In-App Purchases

The App may offer paid plans, subscriptions, or additional content through Apple In-App Purchase. All transactions are processed by Apple; we do not directly collect payment information.

• Prices and terms are displayed in the App at the time of purchase.
• For auto-renewing subscriptions, you may manage or cancel them in iOS Settings > Apple ID > Subscriptions.
• Refund policies are governed by Apple Media Services Terms and Conditions.

6. Acceptable Use

When using the App, you agree not to:

• Upload unlawful, offensive, pornographic, violent, or harmful content.
• Interfere with, disrupt, or attack our systems, servers, or networks.
• Use bots, scripts, or automated tools to access the App without authorization.
• Impersonate any person or misrepresent your affiliation with any entity.

We may suspend or terminate your access if you violate these rules, at our discretion and without prior notice in cases of serious violations.

7. Intellectual Property

The Pham Theu app, including its design, source code, logo, icons, and accompanying content, is protected by copyright, trademark, and other intellectual property laws. “Pham Theu” and related branding are the property of the developer.

Apple Inc. is not the provider of the App and is not responsible for the App’s content, support, or warranty, except as stated in Apple’s Licensed Application End User License Agreement (EULA).

8. Apple Third-Party Terms

The App is distributed through the Apple App Store. Your use of the App is also subject to:

• Apple Media Services Terms and Conditions
• Licensed Application End User License Agreement (Standard EULA)
• App Store Review Guidelines

To the extent of any conflict between these Terms and Apple’s Standard EULA regarding App Store licensing, Apple’s EULA governs.

9. Privacy

Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. Please read it before using the App.

10. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, completely secure, or meet all of your requirements. Embroidery instructions in the App are for reference; actual results depend on your skill and materials.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR LOST-PROFIT DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

Our total cumulative liability for any claim relating to the App shall not exceed the amount you paid to us (if any) in the 12 months before the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Pham Theu, its personnel, and partners from any claims, damages, or expenses (including reasonable legal fees) arising from your violation of these Terms or unauthorized use of the App.

13. Termination

You may stop using the App at any time by uninstalling it from your device. We may suspend or terminate your access if you violate these Terms, or if we discontinue the App.

Provisions regarding intellectual property, disclaimers, limitation of liability, and indemnification survive termination.

14. Changes to These Terms

We may modify these Terms from time to time. When material changes are made, we will notify you through the App or update the “Last Updated” date at the top of this page. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law and Disputes

These Terms are governed by applicable law. Any dispute shall first be resolved through good-faith negotiation. If negotiation fails within 30 days, the dispute shall be submitted to a court of competent jurisdiction, subject to mandatory consumer protection laws in your country of residence.

16. General Provisions

• Severability: If any provision is invalid, the remaining provisions remain in effect.
• No waiver: Failure to enforce a right does not constitute a waiver of that right.
• Assignment: You may not assign your rights under these Terms; we may assign them in a merger or asset sale.
• Entire agreement: These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the App.
